At the end of the twentieth century, the Ayatollah Marʿashī Najafī Library acquired a fourteenth-century manuscript of munshaʾāt previously held in a private collection. This composite multitext manuscript contains about two hundred letters sent by or to officials of the Rūm Saljūq sultanate in the thirteenth century. The letters include official and private correspondence as well as decrees of nomination. They are all in Persian. This article is a first study of the codicological features, structure, and contents of this manuscript. (...) It suggests a production process that unfolded in several stages over a period of seventy years, from the reign of Ghiyāth al-Dīn Kay-Khusraw II to the second decade of the fourteenth century. The Marʿashī manuscript expands considerably the volume of documents available on Saljūq Anatolia during the beginning of Mongol period. It is poised to become a major source on the political history of the period and will also help to understand the integration of Anatolia into the Persianate sphere. (shrink)

From the ancient Egyptian tale of a Shipwrecked Sailor through to Sinbad and Robinson Crusoe, the stranded castaway living and philosophizing alone on a strange, desert island is a theme which has captured the imaginations of writers spanning cultures and millennia. Most familiar to Western literary historians is Daniel Defoe’s Robinson Crusoe, which inspired generations of writers from Jonathan Wyss and William Golding to Michel Tournier and J.M.Coetzee. However, little attention has been paid to Defoe’s antecedents, such as the remarkable (...) HayyIbn Yaqzan by twelfth-century Arab physician and philosopher, Muhammad Ibn Tufayl. Mahmoud Baroud here conducts a detailed comparative textual analysis of Hayy Ibn Yaqzan and Robinson Crusoe, and concludes that Daniel Defoe was likely to have been deeply influenced by Ibn Tufayl’s Arabic text. This volume presents six essays by leading sociologists, philosophers, physicists, and environmental activists that examine the links between science and violence from the Baconian era to the present day. It looks at two basic issues: science as it provides a new justification for state violence; and science as violent technological intervention, invading and disrupting stable patterns of private life in the name of progress and development.

These six essays present an outsider's view of Western norms of progress, rationality, and maturity, and offer an alternate perspective on oppression in modern times. The historical mode may be the dominant mode of constructing the past in most parts of the globe but it is certainly not the most popular mode of doing so. The dominance is derived from the links the idea of history has established with the modern nation-state, the secular worldview, the Baconian concept of scientific rationality, nineteenth-century theories of progress and, in recent decades, development. This dominance has also been strengthened by the absence of any radical critique of the idea (...) of history within the modern world and for that matter, within the discipline of history itself. As a result, once exported to the nonmodern world, the historical consciousness has not only tended to absolutize the past in cultures that have lived with open-ended concepts of the past or depended on myths, legends, and epics to define their cultural selves, it has also made the historical worldview complicit with many new forms of violence, exploitation and satanism in our times and helped rigidify civilizational, cultural, and national boundaries. ABSTRACT The discourse on honesty and dishonesty in academic work has seen considerable growth over the past two decades. This study empirically analyses the shifts in the literature over the past two decades in the research focus and most prolific authors, institutions, countries, and journals. A broad list of terms was employed from the Glossary of Academic Integrity to shortlist journal articles (n = 782) from Scopus. A bibliometric analysis was conducted for each decade and the results were compared. Research (...) outputs and number of clusters were over two-fold in the second compared to the first decade indicating an increase in volume and complexity. The study found a continued focus on plagiarism and academic misconduct research, though academic integrity and contract cheating emerged in the second decade. Shifts were evident in the output signifying a diversification of the research base and perspectives. Further research and action are needed to develop integrity as the broadest defense against dishonesty in all spheres of academia. (shrink)

Self-plagiarism requires clear definition within an environment that places integrity at the heart of the research enterprise. This paper explores the whole notion of self-plagiarism by academics and distinguishes between appropriate and inappropriate textual re-use in academic publications, while considering research on other forms of plagiarism such as student plagiarism. Based on the practical experience of the authors in identifying academics’ self-plagiarism using both electronic detection and manual analysis, a simple model is proposed for identifying self-plagiarism by academics.

The authors argue that the chain of events which they describe is the end-product of a century's effort to convert Hindus into a 'proper' modern nation and a conventional ethnic majority. Simultaneously, the effort is equally to turn the followers of other Indian faiths into well-behaved ethnic minorities and nationalities. The American model of a 'melting pot' is being imposed with the expectation that it will dissolve India's primordial identities. A society which has for centuries been a salad bowl of (...) diverse communities, each identifiably different but constituting parts of a whole, is being forced to conform to the pattern of a 'proper' nation-state. This research examines the descriptive and textual contexts of the Rashidun caliphs Hazrat Abu Bakr (d. 13/634), Hazrat Omar (d. 23/644), Hazrat Othman (35/656) and Hazrat Ali (d. 40/661) in the examples of signatures. However, it examines the general contexts of these signatures and aims to relate these detachment examples with their senders who have the qualifications of authority, eloquence and justice. These signature texts must be handled with full grace, awareness, forethought and responsibility, without any additions or reductions to (...) the text by the recipient. The research deals with the production area of signature and examines the forms of expression in terms of the interpretation and testify (istishad) included in these texts. In addition to these features, the research has applied to the texts of signature, which express a certain treatise, in order to express their expressions and to reveal the rhetorical aspects and textual differences they contain. As a result of the research, it has been seen that the Rashidun caliphs wrote the texts of signature with such qualities as wisdom, persuasion, lacotical (îcâz), suggestion, concentration, open-mindedness and avoidance of closedness, and in accordance with a goal. As a result of the research, it was seen that the signatures revolved around a pattern of focusing and concentrating on the meaning, combining the filtered beautiful words and the clarity of the wording and the literary aspect of the meaning. Finally, the caliphs used these signatures in line with a certain goal to solve many political and social issues. (shrink)

Two sample populations, one refugee and one resident, were studied. The frequencies of consanguineous marriages came out to be 49·8% and 55·4%, respectively, for the refugees and the residents. Caste endogamy was dominant both in the residents and the refugees. The mean coefficient of inbreeding was calculated to be 0·0303 for the refugee population and 0·0332 for the resident population samples. First cousin marriage was the dominant type of marriage in both samples; fathers daughter (FBD) marriage was more frequent among (...) the refugees while mothers daughter (MBD) marriage was more frequent among the residents. Education has no decreasing effect on the incidence of consanguineous marriages. A significant difference in the pattern of marriages in the refugees is observed after the Saur Revolution of 1979. We discuss a recent approach to investigating cognitive control, which has the potential to deal with some of the challenges inherent in this endeavour. In a model-based approach, the researcher defines a formal, computational model that performs the task at hand and whose performance matches that of a research participant. The internal variables in such a model might then be taken as proxies for latent variables computed in the brain. We discuss the potential advantages of such an approach for the (...) study of the neural underpinnings of cognitive control and its pitfalls, and we make explicit the assumptions underlying the interpretation of data obtained using this approach. Background: There is evidence that household point-of-use water treatment products can reduce the enormous burden of water-borne illness. Nevertheless, adoption among the global poor is very low, and little evidence exists on why. Methods: We gave 600 households in poor communities in Dhaka, Bangladesh randomly-ordered two-month free trials of four water treatment products: dilute liquid chlorine, sodium dichloroisocyanurate tablets, a combined flocculant-disinfectant powdered mixture, and a silver-coated ceramic siphon filter. Consumers also received education on the dangers of untreated drinking water. (...) We measured which products consumers used with self-reports, observation, and chlorine tests. We also measured drinking water's contamination with E. coli. Findings: Households reported highest usage of the filter, although no product had even 30% usage. E. coli concentrations in stored drinking water were generally lowest when households had Water Guard. Households that self-reported product usage had large reductions in E. coli concentrations with any product as compared to controls. Conclusion: Traditional arguments for the low adoption of POU products focus on affordability, consumers' lack of information about germs and the dangers of unsafe water, and specific products not meshing with a household's preferences. In this study we provided free trials, repeated informational messages explaining the dangers of untreated water, and a variety of product designs. The low usage of all products despite such efforts makes clear that important barriers exist beyond cost, information, and variation among these four product designs. Without a better understanding of the choices and aspirations of the target end-users, household-based water treatment is unlikely to reduce morbidity and mortality substantially in urban Bangladesh and similar populations. © 2011 Luoto et al. This essay argues that the practical reason approach to the study of social conventions (and social normativity more generally) fails to adequately account for the fluency of social action in environments that we experience as familiar. The practical reason approach, articulated most recently in Andrei Marmor’s Social Conventions: From Language to Law (2009) does help us, though not wholly adequately, to understand how we tend to react to, and experience, unfamiliar situations or unfamiliar behaviors, that is, those situations in which (...) a certain practice becomes problematic or is problematized, or where we are obliged to, or moved to, justify or deliberate. The reason why the practical reason approach is not wholly adequate when it comes to understanding unfamiliar situations or unfamiliar behaviors is that it tends to subsume the unfamiliar under the familiar, that is, it tends to negatively evaluate anything that is deemed to be not in accordance with the rules and reasons already familiar to the observer. This excludes the possibility of the observer having to transform himself or herself, and thus change what is familiar to him or her. (shrink)

A teaching method may not work for all students. Therefore, attention should be paid to the type of students entering the learning environment in order to explain how they perceive the learning environment and achieve. This study investigates students? perceptions and achievement in four learning environments that differed in the degree to which case-based and lecture-based learning were implemented (either separately or combined), hereby making use of students? motivational and learning profiles. Participants were 1098 first-year student teachers who took a (...) course on child development. Results showed that autonomously motivated deep-strategic learners were significantly more positive about each type of learning environment than little motivated and less pronounced deep-strategic learners. However, with regard to achievement, student profiles did not differ. Instead, the learning environment proved to be of significant influence: students in a gradually implemented case-based setting and a completely lecture-based setting scored significantly higher than students in a completely case-based setting. Students’ attitudes towards plagiarism and academic misconduct have been found to vary across national cultures, although the relationship between national culture and students’ perceptions of plagiarism policy remains unexplored. Student survey data (n = 1757) from the UK, Czechia, Poland and Romania were analysed for differences in students’ perceptions of three specific aspects of plagiarism policy – access, support and detail – at their respective universities. Considered through the lens of Hofstede’s cultural dimensions, the study found significant differences between the (...) UK and the three Eastern European countries for all measures except students’ awareness of the penalties applied for plagiarism. Low ‘power distance’ and high ‘individualism’ were related to positive perceptions of plagiarism policy and process. In a questionnaire study on organ allocation 348 students of medicine (102) and economics (246) at the universities of Halle (114 students) and Hannover (234 students) responded to questions concerning their basic attitudes toward alternative criteria of organ allocation. Medical criteria were widely accepted by the respondents. Considerations concerning the patient's value to society were seen as being of minor importance. With respect to reciprocity, we could detect a high share of respondents who would favor former living donors and discriminate (...) against murderers. Among considerations of fairness, the criterion of waiting time gained the highest support. Furthermore, majorities favored the view that health-compromising behavior and differences in age should play a role. Economic considerations were strongly rejected as criteria of organ allocation. Health is certainly a valuable asset in the life of every human being and of particular relevance for a flourishing childhood. As empirical research concerning the social determinants of health shows, its distribution can, at least to a certain extent, be influenced by the way a society is arranged. Many philosophers now acknowledge that a fair distribution of health has to be a central part of a just society and they discuss to what extent a right to health can be (...) justified. However, they do not typically distinguish between physical and mental health and neglect the special problems arising from these distinct, though related, perspectives. In this paper, we argue in favour of such a distinction and ask whether a minimally just society ought to include mental health among the goods that are to be distributed in a fair way among its children. Furthermore, we investigate the relationship between mental health and happiness and ask whether making mental health a subject of justice implies that children are entitled not only to a healthy but also to a happy childhood. Despite the positive impact of happiness on the lives of children, we conclude that happiness cannot be incorporated into a functional theory of justice, since it does not fully meet the criteria of objectivity, measurability and influenceability. Experts in the field of organ transplantation had to rank order a set of 32 patients according to their priority in receiving a donated kidney. The patients were described by the five characteristics that are incorporated in the kidney allocation algorithm applied by Eurotransplant. The priority rankings as defined by the experts were analyzed and patterns of dedsion making identified in the rankings investigated in this study. All patterns could be explained by some type of lexicographical ranking. The larger group (...) of experts preordered tissue compatibility or, more technically speaking, the criterion of HLA match, while the complementary group applied the criterion of the length of waiting time first. Analyzing the finer decision structures of expert rankings and com paring the method of pattern exploration with a conjoint measurement analysis led to two follow-up questions: First, how can the value judgments of the experts be described adequately? Second, which type of aggregated ordering derived from the individual rankings represents them ‘best’? (shrink)

This article explores the maternal experiences of a heterogeneous group of 26 mothers from Granada. The aim is to analyse the needs and demands that these women express with regard to childrearing, using a qualitative methodology. The authors conducted in-depth interviews and analysed the discourses of the mothers following the hermeneutical method. The variables used for sample selection and the themes that emerged during the interviews revealed that the discourses of the mothers revolve around three dimensions: indifference, demands and resignation (...) regarding support for childrearing. The lack of paternal involvement in childrearing appears as a transversal dimension. This article shows that the material conditions of existence marked the differences in the responses of the women regarding support for childrearing, while the sexual division of labour and gender inequalities unified their discourses. This collection of original essays brings together leading legal historians and theorists to explore the oft-neglected but important relationship between these two disciplines. Legal historians have often been sceptical of theory. The methodology which informs their own work is often said to be an empirical one, of gathering information from the archives and presenting it in a narrative form. The narrative produced by history is often said to be provisional, insofar as further research in the archives might falsify present understandings (...) and demand revisions. On the other side, legal theorists are often dismissive of historical works. History itself seems to many theorists not to offer any jurisprudential insights of use for their projects: at best, history is a repository of data and examples, which may be drawn on by the theorist for her own purposes. The aim of this collection is to invite participants from both sides to ask what lessons legal history can bring to legal theory, and what legal theory can bring to history. What is the theorist to do with the empirical data generated by archival research? What theories should drive the historical enterprise, and what wider lessons can be learned from it? This collection brings together a number of major theorists and legal historians to debate these ideas. (shrink)

Review Essay of Stephen P. Turner, Explaining the Normative, 2010.

This paper offers an example of what may be called ‘an aesthetic history of legal and political thought’. Such a task engages in theorising historically the features of aesthetic traditions that enable and further normative inquiry, i.e. an exploration of the norms and values that might contribute to the good life and the common good. The three features offered in this paper as useful to identifying such aesthetic traditions are communality and interactivity, experimentalism, and exemplarity. The paper shows how each (...) of these features is present, in particular ways, in one specific aesthetic tradition, namely the declamatory tradition. Tracing the declamatory tradition back to Ancient Rome, and examining its influence in the English Renaissance, especially in Sir Thomas More’s response to Lucian’s declamatory thema, Tyrannicide, the paper argues that the particular ways in which declamatory practice combines the above three features enables those engaged in it to pursue normative inquiry. The paper argues that the integration of these three features is especially visible in one aspect of declamatory practice, namely the introduction and exchange of colores, i.e. changes in the narrative, introduced by declaimers and their audiences, which shed light on the possible motivation of a character, and thereby also invited shifts in affective allegiance and evaluative perspective. The paper argues that it is in large part through such introduction and exchange of colores that the declamatory tradition enables and furthers normative inquiry, and thus also offers a good reason for including the declamatory tradition in ‘an aesthetic history of legal and political thought’. Stripping the Virgin Mary of the myths, stories, and dogmas surrounding her is a task that has particularly appealed to a branch of feminist theology which seeks to reclaim her as a figure of female empowerment. This article aims to explore the transformation of Mary’s body into an element of resistance in the work of some contemporary artists. By depicting her nude or semi-nude, artists disrupt the gender values commonly associated with the Virgin and open up alternative possibilities of affirmative (...) selfhood through her body. I contend that, in these works, the Virgin’s body functions as a ‘relational’ body that enters into dialogue with hitherto marginalized categories, such as the carnal, the sensual, the notion of fleshly materiality, or even the excluded sexualities of transgender people. This paper argues that not only does history matter to legal epistemology, but also that understanding legal epistemology can yield a certain understanding of the past. The paper focuses on the common law practice of precedent and argues that there is no set of rules, principles, reasons or material facts that constitute the fixed or foundational content of past decisions, but rather that what is taken by a judge resolving a particular dispute to be the content of past decisions depends (...) on the active and creative construal of relevance engaged in by that judge. Precedents are better thought of as `thick resources with dynamic content'. Such content is constrained by a variety of stabilising practices, but never so constrained as to determine how it can be construed to be relevant. This image of law's past may offer a general view of the past as something with which we can actively and creatively relate in the course of coping with the present. (shrink)
